“Iam convinced by the prosecution that the murder of Kaziba by his brother was planned and meticulously premeditated and executed by the convict,” the judge mentioned while delivering his verdict, “David Batema the resident judge Iganga observed while delivering his judgement.
The High Court sentenced Zeheri Kaziba, a father of five and resident of Matovu Bugumya village, Bukabooli subcounty in Mayuge district to 25 years in jail after the judge found him guilty for killing his brother David Kaziba Budugho over land.
Justice Batema convicted Kaziba based on prosecution evidence which indicated that the deceased were having a long-time grudge with his brother that originated from distribution of land by their father.
“I convict you considering the fact that you had a long-time grudge with the deceased over land and based on the factor that you admitted to having murdered Budugho during interrogation,” the judge ruled.
Prosecution evidence adduced in court indicated that during his transfer to Mayuge police station the accused was interrogated but while recording his extra judicial statement, Kaziba admitted to having murdered the deceased.

“The convict is a useless life killing other useful lives. The Vampire must be put out of action. He is a lazy man who does not want to work and sweat for wealth. It was stupid of him to kill his brother. He died in cold blood,” the judge pointed out.
“The exceptional circumstances of this case are traumatizing, grave and unforgivable that you deserve to stay away from public life. I therefore sentence you to 25- years- behind bars,” Batema ruled.
The judge however, advised Kaziba to appeal within 14 days if he is not satisfied with the verdict.
Court heard that on the 6th night of November 2016 at Matovu- Bugumya village in Bukabooli subcounty in Mayuge district Zeheri murdered Budugho contrary to section 188 and 189 of the penal code Act.
Prosecution heard that the accused and the deceased were having a long-time grudge that originated from the distribution of land by their father. That the accused believed that all his suffering and death of his children was caused by the deceased through witchcraft.
And that while the accused was returning home from Kasokoso trading center, he met with the deceased who he hit with a hoe handle on the head killing him instantly accusing him for being a sorcerer.
Court heard that after murdering his brother, the accused dragged the body from the road to the footpath leading to the well. The following day, the body was discovered, the accused was highly suspected to have murdered the deceased owing to a long-time existing grudge between him and the deceased.
The matter was reported to Kigandalo police post leading to Zeheri’s arrest but upon searching his home, a hoe and gum boots stained with blood were discovered in his premises.
During his transfer to Mayuge Police station, an extra judicial statement was recorded of the accused admitting to having murdered the deceased.
A post mortem examination carried out on Budugho’s body at Kigandalo Health Centre iv indicated that he had multiple deep scalp wounds, deep cut wounds in the brain. And that the cause of death was declared to be hypyolganic shock and secondary severe bleeding.
