Kampala High Court on Tuesday issued an order staying the trial of City Business man Muhamad Kamoga, the proprietor of Kamoga Property Consultants until cases he filed in superior courts are disposed of.
In his ruling, Justice Muwata noted that trying Kamoga on criminal charges resulting from the Land matter of Peter Babingamba’s land (forging of land titles) will be unfair when there are other civil matters from the same case that have not been concluded.
Kamoga, who was present in court with his lawyers, welcomed the court decision which he described as a very big landmark in the move to attain back his full freedom.
Prosecution in the case before Entebbe Magistrates Court, Peter Babingamba accuses. The businessman breach of contract when he failed to process land titles for people seated on his 200 acres of land located in Bukaaya – Katabi Town Council in Entebbe Municipality, but instead resorted to forge them.
Earlier on, Kamoga petitioned the High court challenging his trial on grounds that the cases in lower court can’t proceed when there are two other cases both in High and Court of Appeal resulting from the same matter.
He therefore asked to issue an order halting the trial before Magistrates court until the Cases in superior courts are fully heard and disposed of.
Case Background
It is alleged that on May 7, 2021 at Wakiso Lands office, Kamoga with intent to deceive forged a transfer form dated May 7 in respect to land on block 435 plot 8 purporting to have bought it from Bibangamba Peter which was false.
In this matter, Kamoga is also accused of uttering a false document where it is alleged that he submitted the said forged documents to the Registrar of titles purporting it to be signed by Bibangamba whereas not.
