The Attorney General, Kiryowa Kiwanuka has filed a notice of appeal blocking Mityana Municipality Member of Parliament ,Francis Zaake impeachment Court ruling.
Earlier today, the Constitutional Court in Kampala consisting of four judges including Irene Mulyagonja, John Oscar Kihika, Eva Luswata, and Muzamiru Mutangula Kibeedi quashed a resolution by Parliament to suspend Mityana Municipality Member of Parliament, Francis Zaake, from the position of parliamentary commissioner saying the house breached rules of procedure.
In the ruling, Catherine Bamugemereire ruled that The Speaker of Parliament Annet Anita Among breached the rules of natural justice when she acted as a judge in her case by continuing to preside over Parliament in sessions regarding Zaake.
The Judges faulted Parliament for by-passing rules of procedure impeaching Zaake without quorum and amending the committee report and the order paper to include a resolution to suspend him.
Court ordered Government pay Zaake
The Court has ordered that the Government pay Zaake half of the costs.
Case Background
In March 10, 2022, Zaake petitioned the court seeking to reverse his removal from office after fellow MPs impeached him for purportedly shaming the speaker. Zaake claimed in his petition that Parliament suspended its own rules of procedure in adopting the motion to censure him.
He further wanted the court to check on what he terms as the excessive powers of the speaker whom he accuses of mistreating MPs and treating them as her slaves.
Zaake’s troubles stopped from a social media post in which he allegedly disrespected Among, prompting the Gulu West MP Francis Mapenduzi to move a motion to have him removed from office. On March 10, 2022, the said committee found Zaake guilty of breaching the rules of Parliament and asked him to apologize to the speaker and the entire house but declined.End
