In a groundbreaking decision this morning December 14, 2023, the Court of Appeal of the High Court in Kampala, presided over by Deputy Chief Justice Buteera Richard, Lady Justice Irene Mulyagonja, and Justice Geoffrey Kiryabwire intervened in the controversial case brought forward by tycoon Justus Kyabahwa against the Uganda Muslim Supreme Council (UMSC). The court has issued an injunction, preventing the sale of any Muslim properties until further notice.

The Court’s ruling highlighted irregularities in the attachment of UMSC’s properties, citing malpractice and a lack of due diligence by Justus Kyabahwa’s legal representatives. UMSC’s legal team, led by Counsel Musa Kabega and Counsel Dr. Adam Kibwanga Makmot, along with other counsels, presented their case. Notably, Justus Kyabahwa’s representatives were absent during the proceedings.
Council Kyambadde Akram officially announced the court’s decision, revealing that the ruling was a response to tycoon Kyabahwa’s lawsuit, which sought the recovery of an outstanding debt totaling 19 billion shillings from the Uganda Muslim Supreme Council.

The case, heard by the three judges, was characterized by the absence of a prior property evaluation, a point emphasized by Council Kyambadde Akram. This lack of assessment raised concerns about the validity of any potential property sale to settle the debt.
In an astonishing twist, Sheikhs Aruma, a prominent figure within the Muslim community, corroborated the information, confirming that the Court of Appeal has effectively halted the sale of Muslim properties. This includes the Muslim headquarters, which was at risk of being sold to cover the substantial debt owed to tycoon Kyabahwa.
